Rules

These rules are to be used as a reference and are presented in summary form.

Types of Homes

All homes must be single family homes, 2-1/2 story max, and have either a 2 or 3 stall garage.


Annoying or Bothersome Activities

No noxious or offensive activities or anything that is an annoyance or nuisance to the neighborhood can occur on Timberline properties.


No Commercial Vehicles in Driveways...

...except deliveries


Accessory Buildings (i.e. sheds)...

...must be of the same architectural style, materials, color of the home and is to be in strict compliance with Park Township zoning ordinances.


Inoperable Vehicle Time Restrictions

...15 day max for having an inoperable vehicle on your property (except in your garage); and all vehicles must be on paved surfaces at all times.


Excess Dirt Removal

No excess dirt or fill may be removed without permission from HOA.


Recreational Vehicles on Property

No camping trailers, motor homes, water craft or any kind of recreational vehicle may be stored or parked on any lot (except within a garage) for a period longer that a cumulative total of 14 days during a calendar year or for more that 48 hours consecutively.


Signs in Yards

Only signs that are not more than four (4) square feet advertising a lot or home for sale or a sign used by a developer or builder to advertise the construction or subsequent sale of a dwelling unit are allowed. All other signs require Board approval before being displayed.

Political signs that are in compliance with the Park Township ordinance, below, are permitted up to 30 days before an election and must be removed within ten days after the election. Board approval is not required for a political sign.

A request form must be submitted to the Board before starting any sign construction. Please allow up to 45 days for the request to be processed.

Home and Yard Upkeep Expectations

All lot owners shall maintain the exterior of their home, lawn, and landscaping in a neat and attractive manner, and in good condition and repair.


Fences

Covenants require approval from the Board for any fence that is higher than three (3) feet. Chain link, welded wire, or unfinished wood fences (including dog runs) are not allowed unless an exception is approved by the Board.

A request form must be submitted to the Board before starting any sign construction. Please allow up to 45 days for the request to be processed.

Driveway Restrictions

A solid concrete, asphalt or paving brick driveway must connect the street to the garage of each home.


Mandatory Membership in Homeowners' Association & Compliance with Bylaws

Every homeowner must be a member of the Homeowners' Association and is required to comply with the rules adopted by the association (Bylaws, Articles of Incorporation, and Timberline Covenants). Every member must pay annual dues of $50.

Limit of Number of Animals

No more than 4 dogs or cats per residence.

Nuisance

An animal is considered to be a public nuisance if any of the following apply:

  1. Chases passersby or passing vehicles;
  2. Attacks other animals;
  3. Is at large three or more times within a year's time;
  4. Damages private property; or
  5. Barks, howls, cries, or runs at large, so as to disrupt the peace of the neighborhood.

Prohibited Acts

It shall be unlawful for any owner to keep, harbor or have charge of, any animal, whether licensed or unlicensed, when any one or more the following facts exist:

  1. The animal is vicious
  2. Has attacked or bitten any person or animal, or has destroyed any property or domestic animal;
  3. The animal, by destruction of property or trespassing upon the property of others, has become a nuisance in the vicinity where kept;
  4. Barking - No person shall permit any dog, when under that individual's control or when on that individual's premises or on premises under his control, to become a nuisance to others by loud barking, howling, or yelping, provided that any complaint on this fact shall be made by not less than two persons from two separate households; or
  5. Running at large. No person shall cause or permit any dog kept by him to run at large within the township. Dogs which are on any street, alley or sidewalk, or any other public place, without being held securely on a leash, shall be deemed to be running at large. It shall be unlawful to permit any dog to run at large on the property of another without the permission of the owner of that property.

Cleaning up after Dog

  1. It shall be unlawful for any person owning or having charge, care or control of any dog to allow or permit such dog to soil any public or private property other than that of the owner, keeper, custodian or person having control of such dog without promptly removing or disposing of, in a sanitary manner, any excreta deposited by a dog upon any public or private property.
  2. This chapter shall not apply to an owner of a leader, guide, hearing or service dog.
  3. Any person who shall violate a provision of this chapter, or shall to fail to comply with any of the requirements thereof, shall be responsible for a municipal civil infraction.

Noise Control

It shall be unlawful for any person to permit persons on his property or on property under his control to make, continue, or cause to make any loud, raucous, or jarring noise, congregation, disturbance, or party, particularly between the hours of 11:00 p.m. and 7:00 a.m., or at any time or place so as to annoy or disturb the quiet, comfort, repose, or peace of persons in any office or in any dwelling or other type of residence, or of any persons in the vicinity; any noise which is clearly audible more than 50 feet from a person's property, or property under his control, shall be deemed a disturbance under the provision of this section.

Open Burning

Open burning is not allowed in Park Township. Exceptions are recreational fires, such as campfires or cooking food (no leaf or rubbish burning).

Complaints

Procedure

  1. First, try to determine if it is a complaint that could be handled with a respectful conversation between you and your neighbor.
  2. Also try to determine if the complaint is an actual violation of our neighborhood covenants (see above)
  3. Fill out the complaint form below (it is best if you have at least one other neighbor to corroborate the discontent) and wait to be contacted by someone from the Board. If you don't hear from someone within the week, please feel free to email us directly at timberlineacresboard@gmail.com.

Repercussions

Verbal notification is issued to the offender. If this does not remedy the situation, then the board will address it more formally with a...

  1. Written warning
  2. Fines, in non-compliance situations
  3. Lien on home (affects credit, risk of foreclosure) - in rare, extreme cases
  4. Police intervention - if the situation dictates it
